The Country Without A Day Rule
Paraguay decides tax residency on status, not on a day count. The three documents that decide status are immigration residency, a national cedula, and an RUC registered with DNIT, and once the three sit in the file the taxpayer is in scope of the local IRP rules from the moment the cedula is issued. The famous one hundred and twenty days is a civil-domicile presumption, not the tax test.
Why The Day Count Is The Wrong Question
The default assumption most international clients carry into a Paraguay conversation is the day count. One hundred and eighty-three days, two hundred consecutive days, half the year plus a day. That reflex comes from European source rules and from the OECD model convention. Paraguay does not run on that reflex. The Paraguayan test for personal income tax residency is status, not days. The status is established by three documents: an immigration residency, a national identity card called a cedula, and a tax registration number called an RUC issued by DNIT. Once all three sit in the file, the taxpayer is in scope of the local IRP rules from the moment the cedula is issued, regardless of how many nights were spent inside the country in the calendar year. PwC Tax Summaries and MERSAN both restate the rule in the 2026 cycle. The day-count reflex is the wrong tool for a status-based system.
The Three Documents That Decide Tax Residency
The first document is the immigration residency permit itself. The permanent residency permit, also called radicacion, comes through the Direccion General de Migraciones. The standard route is two years of temporary residency, then conversion to permanent. Investor routes shorten or skip the wait, and the SUACE one-stop investor programme grants direct permanent residency against a qualifying investment. The second document is the cedula, the national identity card issued by the Departamento de Identificaciones. The cedula carries a personal identification number and is the identifier DNIT uses on every tax filing. The third document is the RUC, the Registro Unico del Contribuyente, registered with the Direccion Nacional de Ingresos Tributarios. The RUC activates the IRP and IRACIS tax ledgers. All three sit in the file before DNIT will issue a tax residency certificate. The certificate is the document a foreign auditor or treaty partner will ask for. Issued inside five to fifteen business days in the 2026 cycle.
What The One Hundred And Twenty Days Actually Are
The one hundred and twenty days number that circulates in popular guides is a civil-domicile presumption, not a tax rule. Articles 151 and 152 of Law 125/91 set the civil-domicile test. The civil-domicile presumption has a single practical effect: someone who habitually lives in Paraguay is treated as domiciled there for civil-law purposes, including succession, contract jurisdiction, and consumer disputes. The presumption is rebuttable. Holding a foreign tax residency certificate and a foreign habitual-living footprint rebuts the presumption in most civil courts. The civil-domicile presumption has no role in the IRP or IRACIS tax tests. DNIT does not check the day count. DNIT checks the three documents: immigration residency, cedula, RUC. The popular guides that lead with one hundred and twenty days are borrowing a civil-law number for a tax-law question. PwC and MERSAN both flag the conflation in their 2026 write-ups.
Rates On The Paraguay Source Side
The IRP, the personal income tax on Paraguay-source income, runs progressive at eight per cent, nine per cent, and ten per cent. The first slice up to PYG 80 million per year, around twelve thousand US dollars at the 2026 reference rate, is exempt. Capital income from Paraguay-source interest, dividends, and rents is taxed at a flat eight per cent. Foreign-source salaries, foreign-source dividends, foreign-source pensions, and gains on foreign assets are outside the tax net under the territorial principle. The IRE, the corporate income tax now branded as IRACIS, runs at ten per cent flat on Paraguay-source corporate income. VAT runs at ten per cent on local consumption. There is no wealth tax. There is no inheritance tax. There is no gift tax. The cleanest territorial play in the region.
Paraguay decides tax residency on status, not on a day count, and the three documents that prove status are immigration residency, a cedula, and an RUC registered with DNIT.
The Investor Routes And The Real Cost
The SUACE one-stop investor programme grants direct permanent residency against a qualifying business investment. Ipanema Partners published a 2026 figure of seventy thousand US dollars for the standard SUACE investment track. That figure is advisory, not statutory, and the qualifying threshold varies with the sector and the headcount plan. The Investor Pass 2026, the stock-exchange modality introduced in the second quarter, raises the qualifying investment to two hundred thousand US dollars against a listed security. That figure is also advisory and subject to the modality rules the stock exchange publishes. Standard non-investor residency costs less than seventy thousand US dollars in government fees and runs on a documented income or rental-income route. The cost line most newcomers miss is the family line. Dependants ride on the principal applicants file at a marginal additional cost that varies with the family size and the dependent ages. Tax residency certificate from DNIT arrives inside five to fifteen business days once the file is clean.
RG 47/2026 And The Crypto Reporting Trigger
RG 47/2026, the general resolution DNIT published in the first half of 2026, extends crypto reporting to foreign-source crypto income above five thousand US dollars per year. The reporting trigger sits on the taxpayer, not on the exchange. The territorial principle does not waive the reporting trigger. A taxpayer with a Paraguay cedula, an RUC, and a foreign-source crypto gain above the threshold must file the reporting form even though the gain is not subject to IRP. Goldenharbors and taxhavendirectory both restate the rule in their 2026 coverage. The penalty for non-filing runs as a percentage of the unreported amount. The penalty is independent of any tax due. Crypto reporting is now a standing compliance item for any territorial-tax residency in the region.
The Regional Comparison Set
El Salvador, the other pure territorial play in Central America, runs on more than two hundred consecutive days per calendar year or main-source-of-income inside El Salvador. The popular guides that quote one hundred and eighty-three days are wrong per the current PwC guidance published on 26 February 2026. The two hundred consecutive day rule is the trap that catches part-year residents. Costa Rica runs on one hundred and eighty-three days, continuous or not, with the Law 10008 digital-nomad visa as a parallel non-resident track. Guatemala, Honduras, and Nicaragua all use a one hundred and eighty-three day rule in any twelve-month period. Bolivia uses a ninety-day trigger in any twelve-month period, the lowest day-count bar in the region, but a weak practical fit. Dominican Republic runs territorial for the first three years of residency only. After year three the foreign passive investment income becomes taxable. Paraguay is the only country in the regional set where the trigger is documentary, not chronological. That is the structural reason the entry cost sits at the bottom of the comparison matrix.
The Practical Read
Three conditions decide whether Paraguay is the right fit. First, the territorial principle must cover the income profile. Foreign-source salaries, dividends, pensions, and capital gains are outside the tax net. Paraguay-source income is not. A founder with Paraguay-source consulting fees or a country-source product line needs to model the IRP and IRACIS rate against the territorial alternative. Second, the operational fit must hold up. Spanish is the working language of DNIT, Migraciones, and the courts. An operator who refuses Spanish is paying for an interpreter on every filing. Third, the bureaucracy tolerance must be honest. DNIT, Migraciones, and Identificaciones are three separate agencies with three separate queues. The whole pipeline lands inside ninety days for a clean investor file and inside six months for the standard residency track. The probability of a clean first-pass landing inside the published timeline sits above seventy per cent in the 2026 Ipanema Partners file. The cheapest pure territorial play in the region is real. The door is paperwork, not capital.
The famous one hundred and twenty days is a civil-domicile presumption under Art. 151-152 of Law 125/91, not a minimum-stay rule and not the test the tax authority applies.
