The Combination Nobody Claimed

Three peptide patent boards, scored on the same five dimensions, came back 83, 72 and 68 out of 100. The split is not in the science. It is in two columns: which blockers are still alive, and how much of the described invention the granted claims actually recite. A dead patent is prior art. Read the board by legal status first and the bare lane shows up.

01

Three Boards, One Method, Three Verdicts

The same five dimensions were applied to three peptide patent spaces: patentability, business value, feasibility, enforceability and freedom to operate, equally weighted and scored out of 100. Coatings against industrial biofouling came back at 83. Heavy metal sensors came back at 72. Agri peptide biostimulants came back at 68. The numbers sit close enough that a careless reader would call the three boards alike. They are not alike. One says file now, one says file with care, one says design around and stay out. The whole difference sits in two columns: which blockers are still alive, and how much of the described invention the granted claims actually recite.

02

The Blocker That Is Already Dead

WO2011034931A2, from Reactive Surfaces, was framed around marine surfaces: ship hulls and barnacle settlement. It has ceased. US8618066B1, the same assignee, expired on lapsed maintenance, and it required two antimicrobial agents working together, a peptide plus a non-peptide. Neither document recites a coated heat-transfer surface operating above 40 degrees Celsius in aqueous flow. Read those two as obstacles and the board looks closed. Read them as prior art and the board is open, because a dead patent stops blocking and starts describing.

03

The Wall That Moves

US20220064219A1, from the University of Pennsylvania, claims medical uses: treating infection and removing biofilm in a medical context. Its specification mentions industrial surfaces in passing. The claims do not reach a coated heat exchanger. That gap between what a family describes and what it claims is where a filing lives or dies. A pending family whose claims are narrower than its specification is a wall that moves, and nobody can say today where it stops.

04

The Side Of The Board That Is Genuinely Closed

Agri peptide biostimulants are blocked, and the block is documented. Plant Health Care and PI Industries hold the PREtec estate: EP3201341B1, US10856546B2 and US10470461B2 across 16 or more countries, claiming any peptide of 12 to 50 amino acids derived from harpin proteins that elicits a hypersensitive or defence response in a plant. It runs to about 2035. Vestaron US11713341B2 covers NCR13 variant peptides to about 2040. Telluris Biotech US11484035B2 covers CED-4 peptide combinations to about 2038. The segment itself is real, at a peptide biostimulant market of 882 million dollars growing 11.5 per cent a year. The obvious class of molecule is the one that is shut.

A dead patent is prior art. It is not a wall.

05

Six Residues Nobody Filed

One lane on that same board is bare. CAP peptides, from the cysteine-rich secretory protein family, carry a core motif of six residues: phenylalanine or tyrosine, threonine, glutamine or isoleucine or valine, valine, tryptophan. Potency sits in the nanomolar range. The work was published across 2025 and 2026 in the academic literature and no patent holds it. That is the whole clean space, and it is narrow: a composition claim on specific sequence variants, nothing wider. Narrow is not the same as worthless. It is the only open door on that board.

06

Ten Families, Four Gaps, One Honest Market

Heavy metal sensors are not empty. They are fragmented, at ten or more narrow families, many of them academic. KR102107907B1, from Korea University and active to 2038, claims an amyloid fibre beta-lactoglobulin electrode. CN114152601B, from Chinese military medicine and active to 2041, claims a cell-free MerR system for mercury and nothing else. PL449082A1 is pending in Poland on an FY7-aa peptide with FITC for fluorescent mercury detection. US8110402B2, from the University of Kansas, expired, and its NCC tripeptide metal-binding motif is prior art only. Inside that crowd sit four gaps: simultaneous multi-metal arrays, arsenic and chromium sensing, peptide lateral flow strips in place of antibodies, and paper microfluidics with peptides, where the patent count is zero. The market here is honest about its size. Peptide sensor revenue is 15 to 30 million dollars, not billions. That moves the question from what to sell to what to hold.

07

The Order Is The Method

Industrial biofilm carries a published cost of 15 to 20 billion dollars a year in fouling and equipment failure. A coating that holds 90 per cent anti-biofilm efficacy after 500 hours of continuous immersion above 40 degrees Celsius has a buyer before it has a product. Read the board in the order that matters: legal status first, then claim scope, then the specification last. Status tells you what is still enforceable. Claims tell you what is actually held. The specification only tells you what somebody hoped for. The probability that a build collides with a family nobody read is not zero. It is the cheapest risk on the board to retire, and it takes an afternoon.

Claims decide. A specification only talks.
